The use of our developed software must comply with all relevant laws and regulations applicable in the client’s jurisdiction. Clients must ensure that their use of the software adheres to legal standards and does not involve any illegal activities.
Client Obligations
It is the client’s sole responsibility to ensure that any gaming software developed by SupportFly is operated in accordance with applicable laws and regulations. This includes, but is not limited to:
- Obtaining all necessary licenses, permits, and clearances required to legally run the software.
- Ensuring compliance with all local, national, and international regulations pertaining to the software’s operation.
- Adhering to any industry-specific regulations that may apply to their business.
SupportFly does not provide any form of licensing for the use of the software. Clients are responsible for acquiring and maintaining all required licenses and permissions to operate the software legally.
No License Included
SupportFly provides development services and delivers software that meets the agreed-upon specifications. However, we do not provide any licenses or permissions for the software. The client must independently secure any licenses or approvals necessary for the legal use and operation of the software. Failure to obtain the appropriate licenses or permissions is the client’s responsibility and may result in legal or financial repercussions.
Limitation of Liability
SupportFly disclaims any liability for losses, damages, or other issues that may arise from the use of the software provided. This includes, but is not limited to:
- Loss of business or revenue resulting from non-compliance with legal or regulatory requirements.
- Legal penalties or sanctions imposed due to the improper use of the software.
- Any other financial or operational losses incurred as a result of the client’s use of the software.
- Clients agree to indemnify and hold SupportFly harmless from any claims, damages, or liabilities arising from their use of the software.
Intellectual Property Rights
All software and content developed by SupportFly are the intellectual property of our company until full payment has been received. Upon payment, ownership of the software transfers to the client, but SupportFly retains the right to use any non-proprietary elements or concepts developed during the project for future use. Clients are prohibited from reselling, redistributing, or reproducing the software in any form without prior consent from SupportFly.
No Guarantee of Earnings or Success
SupportFly makes no guarantees or promises regarding the profitability, effectiveness, or success of the software developed for clients. Any potential for revenue generation or success depends on various factors, including how the software is used, market conditions, and compliance with legal requirements. SupportFly cannot be held responsible for any financial losses or underperformance related to the use of the software.
Non-Disclosure Agreement (NDA)
Any confidential information shared between SupportFly and the client during the course of the project will be protected under a Non-Disclosure Agreement (NDA). Both parties agree not to disclose or share proprietary information with third parties without prior written consent. This clause ensures that sensitive business information, trade secrets, and unique project details remain secure and confidential.
Third-Party Services and Integrations
SupportFly may integrate third-party services or software into the products we develop at the client’s request. However, we are not responsible for the performance, reliability, or legal compliance of these third-party services. Clients must ensure that any third-party integrations comply with relevant laws and regulations, and SupportFly is not liable for any issues arising from the use of these services.
Termination of Services
SupportFly reserves the right to terminate its services with a client if there is a breach of this disclaimer or any other agreements made. This includes failure to comply with legal requirements, non-payment, or unethical use of the software. Upon termination, the client must cease using any software or materials provided by SupportFly, and any licenses or rights granted will be revoked.
No Warranty
SupportFly provides the software on an “as-is” basis, without any warranties of any kind, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
